Thanks for choosing Flinders Island Latitude Charters. Please read all our terms and conditions carefully, they contain important information about your rights and responsibilities.
General Rules:
Please arrive 20 minutes before the departure time of your trip.
We will confirm the departure time within 24 hours of your trip.
Our charter prices are subject to change.
Number of Passengers:
Maximum number of passengers is 8 and there are 2 crew on Vanora.
All customers under the age of 18 must be accompanied by a guardian/parent.
Bookings and Payments:
All bookings require a 30% deposit payable 3 days before departure. The total balance must be paid 24 hours before departure.
All trips are refundable if Flinders Island Latitude Charters cancel or reschedule the trip.
Gift vouchers are non-refundable, and we only reschedule gift voucher bookings.
Privacy Policy:
Flinders Island Latitude Charters respects and protects the privacy of our customers.
All information collected is processed in accordance with the National Privacy Principles, established under the Privacy Act 1988.
The information provided by you when you make a booking or make an enquiry and any other information sent to us by you or otherwise obtained by us about you is only used for the purposes of responding to your enquiry; processing your booking; providing a personalised service; providing you with goods and services as you requested; fulfilling our obligations under law or assisting and evaluating how visitors use our web presence.
Passenger Responsibility:
By utilising Flinders Island Latitude Charters, you agree that:
Flinders Island Latitude Charters shall not be liable for any accident, injury, delay, property damage or personal loss to you and those travelling with you in connection to any charter, accommodation or transportation resulting directly or indirectly from any occurrence or conditions beyond its control including but not limited to acts of terrorism, protests, acts of god, defects in vehicles, strikes, thefts, delay cancellations, civil disorder, disaster, government regulations or changes in itinerary or schedules.
Cancellations and Refunds:
A $30 cancellation fee will be applied upon cancellation of trip to cover admin costs. Unless the trip is cancelled by Flinders Island Latitude Charters.. Flinders Island Latitude Charters requires 7 days’ notice if you wish to cancel your booking. Cancellations made within 7 days of your booking will incur a booking fee of 30% (your booking deposit). Cancelations made within 24hrs of your booking date will be charged the full amount.
You may nominate a full refund of deposit or transfer your deposit to an alternative date if your trip has been cancelled by Flinders Island Latitude Charters.
If a person becomes unwell and requests to be returned back to shore, then no refund will be given. It is also up to the Skipper’s discretion whether or not to return to port.
Flinders Island Latitude Charters will not be held liable for any indirect costs incurred by booking a charter with us, such as travel, meals and accommodation.
Gift Vouchers:
Gift vouchers must be produced at the time of booking.
If the customer holding the voucher misses the trip on the booked day without providing notice or is late and boat has left port, then the voucher will be forfeited.
Gift vouchers are not transferrable or refundable.
Gift vouchers must be redeemed within 12 months (unless shorter time frame specified on the voucher).
Weather:
All charters are subject to suitable weather conditions (the decision is made at the discretion of the Skipper) and we reserve the right to cancel any trip due to bad weather (even at short notice). As this is a safety requirement.
We will confirm if the weather conditions are safe to go ahead within 24hrs of departure.
Off-shore trips are pending on weather conditions. To travel in Bass Strait we require settled conditions that adhere to Marine Board requirements. If inclement weather conditions prevail, it is up to the Skipper’s discretion as to whether the trip will proceed. You may nominate a full refund (minus $30 cancellation fee) of deposit or transfer your deposit to an alternative date if your trip has been cancelled due to weather.
In an instance where the weather may turn unexpectedly it is at the discretion of the Skipper as to whether any, a full, or part refund is given (minus $30 cancellation fee).
Safety Brief:
A safety brief is given on board before departure.
All customers must declare any pre-existing medical conditions or any medication prior to departure (as some people may require special attention).
We have the right to ask any customer to wear a life jacket at anytime. All customers under the age of 18 must be accompanied by a guardian/parent.
If you are feeling unwell or have any symptoms of COVID we ask that you do not partake in the charter for the safety of the other customers.
Recreational Fishing Licence (RFL):
There is no requirement for you to hold a fishing licence in Tasmania for rod and line fishing. Note catch limits will be strictly kept to preserving our fishery on the island. Once bag limits of species have been obtained, we can continue to fish but it will be catch and release.
Customer Behaviour:
It is required that all customers behave in a safe and respectful manner to all staff, other customers and our property. Offensive behaviour will not be tolerated. This includes conduct that is nuisance, dangerous activity or offensive in any way that interrupts the enjoyment of the experience for other persons.
If we find that there has been loss or damage to our equipment or vessel due to negligence or unruly behaviour, then the customer will be liable for replacement or repair of the item (funds will be taken from the credit card that is held for security).
The Skipper reserves the right to cancel a trip and payment forfeited if unruly or unsafe behaviour is displayed. This includes taking all reasonable steps to the removing the offending customer from the vessel at their expense, and notifying the relevant authorities to receive the offending customer onshore to be dealt with accordingly.
All personal belongings will be your responsibility. Where consumer law and other laws permits Flinders Island Latitude Charters to exclude its liability, we will not be liable for:
Loss of, or damage to any luggage, property or other belongings;
Sickness, injury or death during embarkation and/or disembarkation to or from the vessel and/or at any time whilst aboard the vessel itself, unless caused by wilful misconduct or reckless disregard by Flinders Island Latitude Charters. You agree to release Flinders Island Latitude Charters, its crew and personnel from any claim and liability incurred, howsoever occurring.
In the unlikely event of an incident occurring during the course of carriage resulting in personal injury or loss or damage due to perceived negligence of Flinders Island Latitude Charters, you will be responsible to prove that your personal injury or loss or damage was the fault of Flinders Island Latitude Charters or its personnel.
By agreeing to these terms and conditions, you are certifying that you are medically and physically fit and able to participate in Flinders Island Latitude Charters and you will not participate under influence of any illicit drugs, or any prescription medication which would in any way impair your ability to safely participate.
Alcohol:
Alcohol is allowed onboard the vessel; however responsible consumption of alcohol is to be adhered to.
The Skipper reserves the right to: refuse alcohol onboard if they deems it to be unsafe, refuse a passenger onboard the vessel if they are under the influence of alcohol and can cancel the trip with no refund.
